LX401L: INTELLECTUAL PROPERTY LAW (2024-2025)

Course Overview

The course explores patents (right to control an invention) and trade marks (right to control the use of a sign, commonly, but not necessarily, a logo).  We will consider  theoretical arguments for and against them, thresholds which must be met for them to exist and be infringed, the relevant international, regional and UK frameworks and limits on the rights conferred. Particular attention will be paid to contemporary controversies.  We will also consider the various avenues by which these registered rights can be obtained and the relevance of other legal fields to the power conferred.  Assessment is by essay and MCT exam. The course has a strong focus on advanced preparation and enjoyable, supportive and interactive discussion.

Course Description

 

1)           Aims of the Course

             

This course aims to provide students with a firm knowledge and understanding of trade mark and
patent systems. The course explores trade marks and patents from critical legal perspectives and
within their wider legal, policy and practical contexts

 

(2)          Intended Learning Outcomes

 

By the end of this course, you should:
(a)

  • be familiar with the trade mark and patent systems in the United Kingdom and approaches to passing off.
  • have formed critical views on the requirements for registering and enforcing trade marks and
    patents.
  • have developed independent positions on the power and limits of trade marks and patents.
  • have developed independent positions on the extent to which the trade mark and patent systems meet the needs of contemporary society.
  • have developed an awareness of the relationships between patents, trade marks and other
    categories of intellectual property rights alongside other relevant systems of law.

(b)

  • Have developed independent research, analytical, communication and interpersonal skills, working individually and collectively, in writing and orally, through preparing for and participating in seminars and completing assessments.
  • Have developed or improved time management and organisational skills through participating in
    seminars and completing assessments.
