Course Overview

Students studying for the Aberdeen LLB are required to take this course if they wish to use their degree to enter the Scottish legal profession. The course will examine both testate and intestate succession, in the context of the general principles of the law of succession, including legal rights. Furthermore, it will introduce the functions of trusts, the rights of beneficiaries and the powers and duties of trustees. The course is available only to LLB students in Programme year 2 or above and graduates on the 2 year degree.

Course Description

The course will include study of both testate and intestate succession and general principles of the law of succession, including legal rights. The rights and duties of executors and the necessity of confirmation will be examined. The course will in addition examine the function and establishment of trusts, the right of beneficiaries and the powers and duties of trustees. The nature of the various forms of trusts will be investigated and the manner of their constitution and termination analysed.
