Law School Research Centres hosted a successful book launch for Dr Chike Emedosi's new book

On 23 October 2024, the Centres for Commercial Law and Scots Law co-hosted a celebratory launch for Dr Chike Emedosi's new book, 'The Transfer of Rights in Securitisations: A Law and Economics Analysis'.

The book offers the first systematic study of solutions for transferring money claims and related security rights in securitisations, focusing on England, France and Scotland. It adopts a dual comparative method to determine a model solution that is most efficient for securitisations. Using a functional approach, the book examines available transfer solutions in each focus jurisdiction and provides a detailed, up-to-date doctrinal analysis of their relevant laws. This means it will be of significant value for students, academics and practitioners alike.

Dr Emedosi then applies a novel law and economics approach to evaluate the solutions and determine the most efficient model. This approach uses a leximetric methodology to measure the transfer solutions against six key policy objectives, making it an excellent resource for policymakers.

The launch event was well attended by academics, researchers and industry practitioners, including banking and finance lawyers in Scotland. Professor Andrew Steven of the University of Edinburgh opened the event with reflections on the book’s significance, after which Dr Emedosi explained his approach and summarised his findings.

Professor Steven described the book as “ground-breaking. This work is essential reading for anyone with an interest in securitisations, particularly in Scotland, England and France. Its economic analysis offers important conclusions for the optimum legal framework under which securitisations can take place.” Dr Emedosi added, “The book is presently the only academic work that offers a comprehensive analysis of the newly introduced Moveable Transactions (Scotland) Act 2023 and how it will impact securitisations and other transactions involving bulk receivables transfers.”
