International child abduction in Argentina and in Latin America

Abstract
Solutions developed to deal with international abduction cases by the international and the Latin American community - the Hague Convention on the Civil Aspects of International Abduction and the Inter American Convention on the International Return of Children- have proved successful in several countries in the region.
In Argentina, the standards reached by the Supreme Court on the interpretation and the application of the Conventions provisions are well consolidated and have been reproduced by local courts in all the cases on this subject matter. In addition, the new tools developed in the scope of the Hague Conference on Private International Law for optimising the fulfillment of the goals of the Convention and facilitating international cooperation – e.g. Guides to Good Practice- are beginning to be implemented by different courts.
However, this should be considered as a fundamental step for bringing justice to these cases and for fulfilling children´s rights, the biggest challenge that Argentina and other countries in the region face is the duration of the procedures.
The international community has been working on a unified regulation for the procedures in the region, some countries have already implemented this kind of regulation, and others are still working on it.
