Law Reform in Scotland: Moveable Transactions as a Case Study

Professor Steven’s discussion will have a twofold focus. He will firstly discuss law reform in Scotland, drawing on his experience as a Scottish law commissioner, with particular focus on the various ways that academic staff can contribute to and participate in the law reform process. Professor Steven will illustrate the law reform process with reference to the Report on Moveable Transactions (Scot Law Com No. 249) which was published under his supervision in December 2017 and implemented by the Scottish Parliament in the Moveable Transactions (Scotland) Act 2023.

Professor Steven will also discuss the specific reforms introduced by the 2023 Act, including the statutory pledge, a new true non-possessory security right for moveable property in Scots law. Professor Steven will discuss the policy issues addressed by the new security right, previous unsuccessful attempts to reform the law and the consultations leading up to the publication of the 2017 Report.

Andrew Steven holds the Chair of Property Law at the University of Edinburgh and was the Commissioner responsible for property law reform at the Scottish Law Commission from 2011 to 2019. His research focuses on property law and more particularly rights in security. He is the author of Pledge and Lien and, along with George Gretton, Property, Trusts and Succession.
