Since 2015 the European Union and its Member States have been working to create a permanent body to resolve investment disputes. Discussions have started on the reform of investor state dispute settlement more generally and to create a Multilateral Investment Court specifically in the context of the United Nations Commission for International Trade Law (UNCITRAL

This seminar will explore the nature of the existing ad hoc regime for the settlement of investment disputes and ask whether it truly is suitable for the settlement of investment disputes in order to explain why the EU made these proposals. After answering that question the seminar will turn to the question of how a Multilateral Investment Court should be set up, what should be its main features, how should it operate?
