Dr Robert Taylor from the University of Aberdeem will speak on "Exploring the Constitutional Significance of Britain’s Heavy Dependency upon Conventions" as part of the School of Law Research Seminar Series 2014-15.

Abstract

The British constitution has in recent times experienced a number of significant constitutional changes which have cast doubt over the survival of Britain’s traditionally political constitution.  It is submitted, however, that the ongoing debate over the nature of the constitution has overlooked one crucial area: constitutional conventions.  Broadly defined as non-legal but nevertheless politically-binding rules of conduct, conventions are the source of many of the constitution’s most important rules.  Because their existence precludes the need for judicial controls, it is argued that constitutional conventions are paradigmatic of political control and thus of normative value to political constitutionalism.  As a result, this paper will conduct a detailed analysis of the extent to which the constitution’s heavy dependency upon conventions is thus indicative of it remaining predominantly political in nature, taking into account a number of key factors.
