Abstract

The transition to net-zero societies necessitates significant changes that may exacerbate existing social inequalities and injustices. The term ‘just transition’ is employed to emphasise the justice implications of decarbonisation and its societal impacts. This concept has expanded from its original focus on labour issues to include broader considerations of procedural, distributive, recognition, and restorative justice.

This presentation examines the role of litigation in shaping the parameters of a just transition, investigating how it can be utilised to express grievances regarding fairness in the process. It outlines a research agenda aimed at uncovering the complex justice tensions that arise during the transition and how these can be articulated through legal frameworks.

This analysis offers new insights into the role of litigation not only in highlighting justice issues but also in addressing them, ensuring that the journey toward net-zero societies is inclusive, equitable, and just for all. The presentation underscores the tensions and areas that necessitate deeper reflection, challenging simplistic assumptions of win-win outcomes associated with the protection of human rights in the transition to net-zero societies.

Speaker

Annalisa Savaresi is an experienced environmental lawyer with a 20-year track record working with international and non-governmental organizations. She holds the positions of Professor of Environmental Law at the University of Stirling, UK and Professor of International Environmental Law at the Centre for Climate Change, Energy, University of Eastern Finland. Annalisa’s academic portfolio comprises more than 50 peer-reviewed articles and contributions to well-regarded collections, enjoying widespread citations, including by the Intergovernmental Panel on Climate Change. In addition to her academic work, Annalisa serves as the Director for Europe within the Global Network on Human Rights and the Environment. She is a member of the IUCN World Commission on Environmental Law. Annalisa has provided evidence to legislative bodies, including the UK, EU, and Scottish Parliaments. She currently sits on the Board of Environmental Standards Scotland, a body established under the UK Withdrawal from the European Union (Continuity) (Scotland) Act 2021, which oversees the compliance of Scottish public authorities with environmental law.
