Can the European Convention on Human Rights (ECHR) be used to combat climate change? Although human rights-based climate litigation is on the rise globally and has been used successfully in other jurisdictions to hold governments to account for their failures to mitigate against climate change, the European Court of Human Rights (ECtHR) has not yet ruled on the merits of any climate cases. This is soon set to change, following the Grand Chamber hearing of Duarte Agostinho and ors v Portugal, in which six youth claimants argue that Portugal and 31 other European countries have violated their human rights by failing to take sufficient action on climate change. This presentation will therefore examine the role of the ECtHR in adjudicating climate litigation and the extent to which the ECHR is equipped to address the human rights issues that arise from climate change.
