The current political situation in Scotland is essentially a clash between two different types of sovereignty: the legal sovereignty of the Westminster Parliament versus the political sovereignty of the Scots People. This raises issues about which form or sovereignty will prevail which is arguably in turn a question of the legitimacy of sources of authority and these in turn raise questions about what Hart would have termed the rule of recognition in the constitution of Scotland and how, if at all, that differs from the constitution of the UK. These are not merely abstract issues but may be the source of great political and legal debate over 2021-2022 especially if as seems likely the British Government refuses to authorise a second referendum on Scottish Independence.
