Abstract:

Investment arbitration in the European Union is currently experiencing one of its most crucial challenges. At EU level, there are different opinions claiming that the applicability of investment treaties to resolve intra-EU disputes is no longer valid. The main argument flagged is the existence of a conflict between the content of intra-EU investment agreements and EU Law. Parallel to these criticisms, there has been an unprecedented increase of intra-EU disputes, most of these disputes are yet to be decided by international investment tribunals. However, despite the general perception of an asymbiotic relationship of investment arbitration in the EU, there has been limited evidence of a real conflict normative between EU Law and intra-EU investment agreements. This presentation aims to assess the type of normative relationship between intra-EU investment agreements and EU Law.
