Contemporary concerns in commercial law include the effects of new/emerging technologies, impacts of climate change and rise of economic nationalism. Each of these areas of concern present unique opportunities and challenges for commercial law. For example, while new/emerging technologies offer significant efficiencies, they raise questions such as how intellectual property rights apply to innovations and creations generated by artificial intelligence. Similarly, with the increasing reliance on data driven business models, data privacy and protection have become central in commercial law. The implementation of regulations like the General Data Protection Regulation (GDPR) in Europe showcase the growing importance of safeguarding personal information in commercial transactions. The urgency of climate change has introduced new dynamics into commercial law, compelling businesses and law/policy makers to address environmental challenges. Legal frameworks are evolving to tackle sustainability concerns and promote green practices. The rise of green bonds and sustainable investment strategies underscore a growing emphasis on environmental responsibility. Furthermore, the rise of economic nationalism, characterised by protectionist policies and the focus on domestic interests have significant impacts on commercial law, including the pillars of the Centre for Commercial Law (CCL): Corporate and Commercial Law, International Trade Law, Intellectual Property and Technology Law and Dispute Resolution.
In the “Evolving Commercial Law Landscape” series launched by CCL in the 2024/25 academic year, CCL members, associate members, collaborators and partners will explore and unpack critical issues relevant to the theme. The series will delve into how new and emerging technologies are reshaping the orthodoxies of commercial law, how legal frameworks can effectively address the opportunities and challenges that arise from the incursion of new and emerging technologies, effects of climate change and global economic shifts on the development of commercial law alongside the latest legal advancements in commercial law.
