The Use of Blockchain Technology in Cross-Border Legal Cooperation

Blockchain technology offers an open source protocol which is decentralized and consistent through the network. Data added to the blockchain is available and visible to each node of the network and it is very difficult, if not impossible, to remove or change the data without this being detected by others. Blockchain therefore has a significant potential to transform various areas which are traditionally paper-intensive and do require storing, querying and sharing data. Cross-border legal cooperation, utilised by international legal instruments, can be one of them by the use of a private blockchain where the consensus process can only be performed by a limited and predefined number of participants (e.g. central authorities of states acting under a convention). Electronic service of process, judicial cooperation and obtaining evidence via blockchain could enhance the implementation and efficiency of existing conventions while cutting the cost and it could also open the door to further developments for cross-border legal cooperation.
In this seminar, we will discuss whether and how the blockchain technology can be used under some of the existing international legal instruments and which benefits it can offer in cross-border legal cooperation.
Dr Florian Heindler is an Assistant Professor at Sigmund Freud University, Vienna, Of Counsel at Specht attorneys-at-law and works as permanent legal counsel for an Austrian bank.
Dr Burcu Yüksel is a Lecturer in Law, Member of the Centre for Private International Law and Associate Director of the Centre for Commercial Law at the University of Aberdeen.
